Terms of Service

1. Acceptance of Terms

By downloading or using TickSafe ("App"), provided by Polorix Sp. z o.o. ("we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. You must be at least 13 years old to use the App.

2. Description of the App

TickSafe is an AI-assisted mobile application that helps pet owners detect ticks on their animals using a smartphone camera. The App provides real-time detection guidance, daily tick risk levels based on local weather, and a scan history log.

The App is not a medical or veterinary diagnostic tool. Results should always be verified manually. Do not rely on the App as a substitute for professional veterinary advice.

3. Subscriptions

3.1 Certain features require a paid subscription ("Subscription"), available as a weekly or annual plan.

3.2 A free trial may be offered to new users. If not cancelled before the end of the trial period, the trial automatically converts to a paid Subscription.

3.3 All billing is handled by Apple Inc. through the App Store. Payment is charged to your Apple ID at confirmation of purchase. We do not have access to your payment details.

3.4 Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your Subscription in your Apple ID Account Settings.

3.5 We may change Subscription prices. Where required by Apple, you will be notified before any price change takes effect.

3.6 Refunds are subject to Apple's refund policy. We do not process refunds directly.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or modify the App
• Use automated tools to access or scrape the App
• Interfere with the App's normal operation
• Misrepresent scan results or use the App in a way that could harm animals or third parties

5. Intellectual Property

All content, code, trademarks, designs, and materials in the App are owned by Polorix Sp. z o.o. or its licensors. You may not copy, modify, distribute, or create derivative works without prior written permission.

6. Medical & Veterinary Disclaimer

TickSafe is a detection aid, not a certified medical or veterinary device. The App does not diagnose diseases, provide veterinary advice, or guarantee detection accuracy. Always consult a licensed veterinarian if you suspect your pet has been bitten by a tick or shows symptoms of tick-borne illness.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Polorix Sp. z o.o. and its affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the App, including but not limited to missed tick detections or health outcomes in animals.

Our total liability shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or that detection results will be accurate in all conditions.

9. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or create legal or security risks. You may stop using the App at any time by uninstalling it. Termination does not entitle you to a refund.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notice or on our website. Continued use of the App after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of Poland. Any disputes shall be resolved exclusively in the courts of Warsaw, Poland.
